TERMS & CONDITIONS

1.1 These Terms and Conditions will apply to the purchase of goods by you, “The Buyer”

 

1.2 "Buyer" means the person who buys Goods from the Seller;

 

1.3 No clause or condition in these terms & conditions is intended to prohibit you from having all consumer rights applicable under the local law and/or other statutory rights (e.g. under the Sale of Goods Act.

 

1.4 These Terms and Conditions shall apply to all contracts for the sale of Goods by the Seller to the Buyer and shall prevail over any other documentation or communication from the Buyer.

 

1.5 Product type or sizing shall remain the Buyer's responsibility which needs to be confirmed with the Seller. Drawings and Pictures are acceptable as confirmation providing all information Specifications/ alterations have been clearly noted down and confirmed by M&D Woodcraft Ltd. Any information not on such drawing or picture, or in a confirmation message before construction commences, can and will not be considered during the manufacture of the order.

 

1.6 All images are captured for illustrative purposes, and the actual colour of the product may vary a little from that displayed in the picture, all our listings are supplied untreated and in a natural form for a professional commissioned by you to treat. Any treatment is for illustration purposes only, M&D Woodcraft Ltd does not treat or paint any orders.

 

1.7 We reserve the right, without liability or prior notice, to revise, discontinue, or cease to make available any of our products or to cancel any order.

 

1.8 The sizes may vary between 0-5 mm on all timber products/orders, depending upon the environmental conditions.

 

1.9 If you submit a photo to us You must acknowledge that you are giving us the right to use that photo or drawing on our website, social media pages and general advertising including print, unless otherwise denied in writing.

 

1.10 No goods will be sent or constructed until payment has been received and cleared, unfortunately this could mean that the expected delivery date may change from the one that is on your order page.

1.11 All wooden/timber items are supplied in a natural form for you to treat/finish to your desired taste by a professional.

1.12 To be covered by PayPal seller protection policy we can only dispatch items to your registered address.

1.13 Qualified Professionals should be used for surveying the site and choosing treatment. Professionals should be used for fitting all products we supply, failure to do so could be dangerous to you and others.

1.14 Wood is a natural product that expands and contracts, we make every effort to supply you the exact size ordered, although due to environmental changes this can mean that for example your item can expand or contract depending on the time of year.

1.15 We are not responsible for any damage or injury caused by improper use or inadequate fitting and upkeep of any item we supply.

1.16 Payments to be made within 4 working days of auction ending unless otherwise arranged with us prior to buying.

1.17 Any small faults with the timber i.e small knots missing, small splits but not limited to, will be filled with epoxy filler, all our products are good on both faces

1.18 Timber is a natural product and consequently vulnerable to extreme changes in temperature and weather conditions.There may be fluctuation of shape in hot or wet weather, these can but not guaranteed to reverse when the weather returns. Also, please be aware that timber posts can distort in some cases but also can but not guaranteed to return to shape when the weather returns. Timber can split, warp, shrink, bow & twist but will not alter the structural strength of the Product/orders or posts. M&D Woodcraft Ltd cannot prevent against natural warping, shrinking, bowing, twisting, splitting, mound, blue spots and any other movement once the product has been accepted. M&D Woodcraft Ltd can not offer any reimbursement for issues of this kind.

1.19 Timber as being a totally natural product may contain different timber shades from one product/order or component to another which should be expected with all timber species.

1.20 Gate bracing and brace configuration may differ from the image shown, if in our opinion this would be more beneficial for strength and durability for the order.

1.21 should you wish to cancel your order during the process of it being manufactured or after it’s been manufactured we reserve the right to refuse.

1.22 Please note that under no circumstances are we under any obligation to refund or replace a product that has been damaged or stolen after a delivery has been signed by you or your representative, or delivered to a “safe Place”

1.23 To have an item sent to an alternative address you must add the address to your   account prior to purchasing the item.

 

2.1 To have an item sent to an alternative address you must add the address to your eBay account prior to purchasing the item.

2.2 M&D Woodcraft Ltd Does not tolerate Abuse by other Members, you will be reported.

 

2.3 We may use a third-party courier service in some cases. In these cases, please check all items are present and undamaged. If items are damaged they must be refused or signed as damaged

 

2.4 Upon delivery, you must check that the order is not damaged, failure to do this will mean any damage could only have happened after delivery. Detailed photographs must be taken of the packaging and product damage and we must be notified immediately so that we can inform the couriers for insurance purposes.

2.5 We provide free delivery services, where stated, to UK Mainland. Deliveries to excluded areas included but not limited to the Isle of Wight, the Isle of Man, the Scottish Isles, parts of Scotland, Northern Ireland as well as the Channel Isles

 

2.6 We are not responsible for any delay from the courier's side, which is out of our control.

 

2.7 If the recipient is not available at the given address, after getting the notification of delivery, extra charges may have to be added for re-delivery.

 

2.8 You are liable to take care of the package once it's in your possession.

 

2.9 We will not pay any costs or compensation for any delays in your delivery.

 

2.10 If you give us the incorrect delivery information we are not liable for the extra costs which may be incurred to reclaim and resend to you.

 

2.11 If you fail to notify us of damage immediately upon delivery your requests may not be accepted.

2.12 We comply with the Data Protection Act 2018 and respect your privacy. By placing your order, you will be allowing us to use your personal details for the purposes of supplying goods by us and our couriers.

2.13 Gloves and other PPE must be used when handling timber products to prevent splinters and other injuries.

2.14 All packaging should be kept away from children and pets and disposed of in a responsible manner. M&D Woodcraft Ltd does NOT accept responsibility for injury or death resulting in improper disposal of packaging.

2.15 Delivery of goods will be to the address you specified in your order. It is important that this address is accurate. If you are unavailable for receipt of your delivery, please specify clearly where you would like your goods to be placed. We cannot accept any liability for any loss or damage to the goods once they have been delivered in accordance with your delivery instructions.

2.16 If you do not accept our delivery via us or our courier on the first delivery attempt, we are not liable for damage caused during the order being in extended transit in the delivery vehicle, or upon delivery, the delivery company will have informed us how many times they tried to deliver your order, it is important for you to be there for the curbside delivery.

 

3.1 In addition to the Buyer's statutory rights, the seller guarantees all goods against faulty workmanship. Faulty workmanship is defined as horizontal joints pulling apart.

 

3.2 Please note that goods will only be replaced/refunded if they are faulty or differ in any way with the specifications supplied by yourselves at point of order. All products are guaranteed against faulty workmanship, and if any are found we will be happy to replace/repair once they have been returned

 

3.3 Please Note, all orders we sell are classed as made to measure/ bespoke and are made to the consumer’s own specification, your rights to withdraw from the contract is exempt under The Consumer Protection (Distance Selling) Regulations 2002. This does not affect your statutory rights.

 

3.4 We cover against faulty workmanship for 12 months, however due to the nature of the materials i.e. timber, the guarantee/warranty does not cover natural movement, twisting, shrinkage, splits, bowing and all problems relating to this. i.e. guarantee/warranty DOES NOT cover natural movement, twisting, shrinkage, splits, bowing and all problems relating to this.

 

3.5 All Products/orders are supplied untreated. The buyer accepts full responsibility for treatment of all items. Failure to apply sufficient suitable treatment will result in any warranty/guarantees being void.

 

3.6 The guarantee/warranty will also be null and void to products that are 'poorly' fitted or automated when this was not how the gates were purchased.

 

3.7 Orders that have been automated incorrectly, for example but not limited to i.e. underground automation arms not extended, automation arms placed incorrectly, will be classed as abuse. M&D Woodcraft Ltd will NOT take responsibility.

 

3.8 Please note timber is a natural product so these can vary slightly but within our tolerance guidelines of 5mm (10mm overall).

 

4.1 The return cost must be covered by the Buyer unless the item in question is faulty/damaged.

 

4.2 Where returned Goods are found to be damaged due to the Buyer's fault, the Buyer will be liable for the cost of remedying such damage.

 

 

4.3 All orders will be made to your measurements you have provided to us at the time of order with a tolerance of 0 - 5 mm, we will not be responsible and no refunds will be given for products ordered the wrong size.

 

4.4 Waiting to return your order. You have a legal obligation to take reasonable care of the Products while they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation.

4.5 If you return your item via courier and it gets lost in transit we are not responsible or liable. You will have to seek reimbursement from the courier directly, we recommend that you have the return insured and you must inform us of the delivery day and also send us the tracking number.

 

4.6 If you require a return because your product is not as described or defective then we are within our rights to ask for proof via photographs.

 

4.7 We will only pay for goods to be returned if deemed are faulty, delivery must be arranged and paid for by the customer, all returns must be inspected before a refund can be issued. Refunds are normally sent via the same method that the funds were paid, and within 30 days of receiving the item back.

 

5.1 The guarantee/warranty will also be null and void to products that are 'poorly' fitted or automated when this was not how the Products were purchased. And/or automated incorrectly i.e. underground automation arms not extended. M&D Woodcraft Ltd will NOT take responsibility.

 

 

5.2 Splits/Cracks/Warps/Twists/Distortion is NOT a manufacturing fault.

 

5.3 We will not under any circumstances pay out any compensation for products which have to be replaced either before or after installation.

5.4 We recommend that you treat your Products/orders within One week, M&D Woodcraft Ltd cannot be held liable for any wood rot or mold due to a direct result of neglect and so we recommend you treat your gates regularly. You should maintain a good level of protection to all of our products. M&D Woodcraft Ltd are not liable for bowing, shrinking twisting, moving, splitting, expansion or contraction caused and will not cover any ensuing costs as a result of this.

5.5 Wooden products that are treated are to be maintained by the customers professional, as the treatment will need re coating during the lifetime of the products we supply. M&D Woodcraft Ltd cannot cover any maltreatment of the Products.

 

6.1 Time / Delivery: We will not be responsible for any money lost or any other harm incurred due to project bookings. You must not book with Fitters or any other trades people. until the delivery has been made successfully.

6.2 Please refer to Guarantees 5. Timber, wood is a natural organic product. As it is mostly installed outdoors, acknowledge that Extreme weather conditions or unlikely conditions may cause timber to crack and split creating knots, slight blue mould, a minor difference in the appearance, or moist timber, however, it does not affect the integrity and/or structure of the product. Moreover, it is perfectly normal.

6.3 We will endeavour to ensure your order is filled within the time frame given at the time of ordering or, if no time frame is specified, then within a reasonable time of the date of the Order Confirmation, unless there are exceptional circumstances.

 

6.4 We will not be liable for any loss or damage suffered by you through any delay due to unforeseen circumstances outside of the control of M&D Woodcraft Ltd or any of our courier companies.

6.5 Contracts cannot be cancelled if the goods you have ordered are bespoke e.g. made to order from your specifications, this covers all of our products we manufacture and supply or source.This puts them outside of the The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

6.6 If any of these terms and conditions are unenforceable (including any provision in which we exclude our liability to you) the enforceability of any of these conditions will not be affected.

6.7 We do not accept liability for any losses related to any business of yours including but not limited to: lost data, lost profits, lost revenues or business interruption.

6.8 M&D Woodcraft Ltd takes no responsibility for inaccurate measurements by the customer; these items are non nonrefundable.

6.9 Manufacturing process of bespoke orders starts as soon as orders arrive into us as such cancellation of contracts cannot be cancelled This puts them outside of The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

 

 

6.10 M&D Woodcraft Ltd will not be held liable for any twisting, warping, mould, cracks, discoloration and any other form of natural defect of wood.

 

6.11 Nothing in these Terms and Conditions shall exclude or limit the liability of the Seller for death or personal injury, however the Seller shall not be liable for any direct loss or damage suffered by the Buyer howsoever caused, as a result of any negligence, breach of contract or otherwise in excess of the price of the Goods.

 

 

7.1 These Terms and Conditions shall be governed by and construed in accordance with the law of England and the parties hereby submit to the exclusive jurisdiction of the English courts.

We are not responsible for any of your losses related to any business including but not limited to lost data, lost profits, lost revenues or business interruption.

 

 

 

8.1 1979 (as amended)) including our liability to you in case of any death or physical injury resulting from our negligence. As a consumer, you have the legal rights for reporting any faulty or miss described products.

 

8.2 We abide by the Consumer Rights Act 2015 and so you have from 14 days of receipt of your order to cancel and return the item to us in the same condition that it was sent to you, with the following conditions.

 

The product is in the original packaging.

The product is undamaged.

You the Buyer Pays for Return Courier.

The product is Insured for transit.

You provide us with the delivery day and date.

The product is well packaged so not to have any damage upon delivery to us.

You the Buyer Pays a 30% restocking fee, this doesn't apply to a bespoke order.

8.3 You the Buyer have read and understood all our Terms & Conditions

 

9.1 You will only own the goods once they have been successfully delivered. Risk of damage to or loss of the goods passes to you at the time of delivery. M&D Woodcraft Ltd does NOT accept responsibility for injury, loss or death under any circumstances upon delivery.

10.1 Before placing an order with us you must have the site surveyed by a qualified professional.

10.2 All fitting/installations of any of our products must be carried out by a qualified professional, all treatment must be carried out by a qualified professional.

10.3 All treatment should be undertaken after the necessary holes have been made for lock, hinges etc so that the whole of your item is protected.

10.4 All goods must be installed correctly and apply to strict building regulations. Any automated gates must be pressure tested after installation and have additional safety edges/ photocells required to ensure the product meets all safety expectations. M&D Woodcraft Ltd are not to be held responsible for any goods installed by other parties for damage, injury or loss of life.

10.5 The guarantee/warranty will also be null and void to products that are 'poorly' fitted or automated when this was not how the product was purchased. And/or automated incorrectly i.e. underground automation arms not extended. M&D Woodcraft Ltd will NOT take responsibility.

 

10.6 If any installation whatsoever in part or full occurs before informing us of any incorrect size,delivery damage, faults, missing or incorrect items then M&D Woodcraft Ltd are under no obligation to repair, replace or refund them as well as any re-installation costs.

 

 

11.1 Upon cancellation by the customer, we reserve the right to refuse any refund for a bespoke product made to your specifications.

11.2 Unfortunately, due to the made to order nature of all our products you agree that should you wish to cancel the purchase once the manufacturing process has begun you will be subjected to a 30% restocking charge on Standard Sizes, this does not apply to bespoke orders.

 

11.3 As stated here in these terms and conditions all notices from you to us must be in writing and sent to our office

12.1 These Terms and Conditions shall be governed by and construed in accordance with the law of England and the parties hereby submit to the exclusive jurisdiction of the English courts.

 

12.2 If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid, illegal or unenforceable provision eliminated.

 

 

M&D Woodcraft Ltd Reserves the right to change terms and conditions at any point.
